In 2018, Kansas passed Senate Bill 282 which legalizes CBD for all residents of The Wheat State. The bill, signed by Gov. Jeff Colyer in May, exempts cannabidiol (CBD) from the state’s definition of “marijuana” and amends statutes pertaining to crimes involving controlled substances.
Kansas is also one of five states that passed legislation in 2018 to establish hemp research and industrial hemp pilot programs. SB 263 enacted the Alternative Crop Research Act which allows the Kansas Department of Agriculture (KDA) to cultivate and research industrial hemp in accordance with federal law.

In spite of the strict laws enacted in individual states, the U.S. as a whole is becoming very hemp-friendly. The Agricultural Act of 2014, known as the Farm Bill, is a piece of national legislation that permits all states to cultivate and research industrial hemp if they so choose. The law stipulates that industrial hemp products are allowed to be sold in states if the products: comply with relevant state laws, are produced in conjunction with a state department of agriculture, and are produced for research purposes including both medical and market research.
Modern Hemp Legislation
Most importantly, the Farm Bill defines hemp as any cannabis plant or derivative of such plant which contains less than 0.3% THC by dry weight. THC is the psychotropic compound that produces the “high” synonymous with marijuana. In trace amounts of less than 1% by dry weight, THC has negligible effects.
